Can I register my trademark in multiple classes?
Yes, a trademark can be registered under multiple classes that covers the goods and services offered by the owner of the trademark.
The registration of trademark in Nigeria has many benefits which includes;
- Exclusive protection of your trademarks.
- Discouraging others from using similar marks without your consent.
- Notifies the general public about your ownership of the mark by offering public recognition of your trademark.
- Gives the trademark owner the right to file an infringement case at the Federal High Court against unauthorized users.
Generally there are 45 classes of trademark protection in Nigeria. 1-35 covers products, while 36-45 covers services. A company or an individual can possibly offer more than one service or produce more than one product. In such scenario, it is advised that such company or individual registers its services or products under the classes available. Registration of trademark under multiple classes better protects the goodwill of such company or individual.
Application for registration of trademark under multiple classes must be done separately as each class of trademark has its own certificate which makes it easily assignable or transferable.
